Layer 3 Internet respects your privacy and processes personal information in accordance with South Africa’s Protection of Personal Information Act, 4 of 2013 (POPIA).

This policy explains how Rogue Business t/a Layer 3 Internet collects, uses, stores, shares and protects personal information.

1. Who we are
Rogue Business, trading as Layer 3 Internet, is a South African connectivity and technology services company. We provide internet connectivity, hosting, security, device management, technical support, Atlas network services and related digital products to homes, businesses and communities across South Africa.
For the purposes of POPIA, Rogue Business t/a Layer 3 Internet is the responsible party.
2. Information we collect
We may collect the following types of personal information:
- Contact and identity information (name, email address, phone number, identity or company number where required).
- Service addresses and location details needed to provision connectivity.
- Account, order and billing information.
- Customer communications, support requests and WhatsApp messages.
- Network, device and diagnostic information related to the services we deliver.
- IP addresses and website usage information.
- Cookies and similar technologies that help us understand how our website is used.
- Marketing preferences and consent records.
Payment-card details are processed by approved payment providers. Layer 3 does not intentionally retain complete payment-card information.
3. How we collect information

- WhatsApp conversations and other messaging channels.
- Support channels, service installations and network systems.
- Cookies, analytics tools and server logs when you use our website.

5. WhatsApp and automated assistance
Customers who contact Layer 3 through WhatsApp consent to their contact details and message content being processed to provide support, service communications and related assistance.
WhatsApp communications use Meta/WhatsApp infrastructure and may pass through Layer 3’s approved hosting, automation and customer-support systems.
Automated tools or AI may help classify, route or draft responses, with human escalation available where appropriate. You may request a human agent at any time.
6. Direct marketing and opt-out
Layer 3 sends marketing communications only where permitted under POPIA or with appropriate consent. You can opt out at any time by replying STOP to an applicable message or by contacting sales@layer3internet.co.za.
Even if you opt out of marketing, we may still send service, security, billing and outage messages where necessary to provide an active service or meet legal obligations.
7. Sharing of information
We may share personal information only as necessary with:
- Network operators and infrastructure providers.
- Payment processors and billing partners.
- Hosting, cloud and technology providers.
- Meta/WhatsApp for messaging services.
- Professional advisers, auditors and insurers.
- Authorised contractors and installers.
- Regulators, law enforcement or other parties when required by law.
Layer 3 does not sell personal information.
8. International processing
Some of our approved technology providers may process information outside South Africa. Where this happens, we use reasonable contractual and security safeguards to help protect personal information in line with POPIA principles.
9. Retention
We retain personal information only for as long as required to provide the service, fulfil legitimate business purposes, resolve disputes and meet applicable legal or regulatory requirements. After that period, information is deleted, anonymised or securely archived.
10. Security
We apply reasonable administrative, technical and physical safeguards to protect personal information. These include access controls, authentication, monitoring, backups and incident-response measures. No internet transmission method can be guaranteed completely secure, and we encourage customers to use strong passwords and keep their account details safe.
11. Customer rights under POPIA
Under POPIA you have the right to:
- Request access to your personal information.
- Request correction of inaccurate or incomplete information.
- Request deletion of personal information in certain circumstances.
- Object to certain processing, including direct marketing.
- Withdraw consent where processing is based on consent.
- Lodge a complaint with South Africa’s Information Regulator.

12. Cookies

General Layer 3 services are not intended for children acting without a parent or guardian. Personal information relating to children will only be processed with appropriate authority or another lawful basis under POPIA.

15. Changes to this policy
We may update this Privacy Policy from time to time. When material changes are made, we will revise the effective date. Continued use of our services after changes indicates acceptance of the updated policy.
